TikTok’s child safety controls did not work the way parents were led to believe, according to a Texas judge.
The court ruled Thursday that TikTok violated the Texas Deceptive Trade Practices Act, granting summary judgment on claims that the platform misrepresented its content filtering and protections for younger users.
The decision resolves the liability question before trial, shifting the case toward potential financial penalties and operational remedies.
TikTok publicly said content violating its Community Guidelines would be removed. Internal moderation instructions, however, directed reviewers in some cases to classify that material as “hard to find” rather than “do not allow,” according to court filings.
Texas District Judge Cory Liu determined that this internal sorting method permitted explicit and rule-breaking material to linger on the network. Liu further found that TikTok’s marquee parental guardrail, “Restricted Mode,” failed to operate as promoted.
Internal company discussions revealed staff acknowledged the tool “exposed users to a high amount of content that should have been filtered out,” leaving younger audiences exposed to graphic imagery, drugs, and sexually suggestive media.
Texas Attorney General Ken Paxton, whose agency launched the suit in January 2025, praised the determination, stating that TikTok “sacrificed the safety and innocence of children for engagement and numbers, and now they are being held accountable.”

With deception legally established, an upcoming trial slated for next month will bypass questions of fault to focus exclusively on financial penalties and potential operational injunctions.
That distinction matters. Texas did not simply secure a settlement with the company; it obtained a court ruling that TikTok’s representations about its child-safety protections violated state consumer-protection law.
